Senior Associate General Counsel – Labour & Employment
As an experienced Labour and Employment Lawyer, you will use your customer service skills to provide high quality and timely legal services to Micron senior management, team members and business units in India, Singapore and Malaysia. You will be responsible to support Micron’s policies and build effective working relationship with team members and business units.
Minimum Required Qualifications:
- Law degree
- Over ten years’ experience as a labour and employment lawyer, either with a law firm in India or multi-national company
- Honesty and integrity with high standards of ethics
- Analytical ability and experience in legal drafting and negotiation skills regarding a broad variety of agreements
- Confidence to speak on legal issues to internal customers and familiarity to navigate through complex processes
- Excellent communications skills, both verbal and written, including fluency in spoken and written English
- Ability to forge strong and effective working relationships across a variety of stakeholder groups
- Possess a keen problem-solving approach that benefits Micron’s business needs
- Candidate will need to able to commute to work in Hyderabad
Additional Desirable Experience:
- Experience working for technology companies
- Experience working in Hyderabad/Telangana, Bangalore/Karnataka, Delhi/Delhi and other states in India, dealing with labour authorities across states in India, and handling matters arising specifically under State laws including Telangana, Karnataka, Delhi etc.
- Experience with Singapore law, dealing with pertinent labour authorities
- Experience with Malaysia law, dealing with pertinent labour authorities, and handling matters arising under federal and state laws, including Sharia law
- Experience with immigration, employment benefits and employee tax issues
- Experience conducting training about labour and employment legal issues
- Experience with negotiating with, and handling disputes involving, trade unions
Work Responsibilities:
You will be the single/initial point of contact and subject matter authority to apply expert labour and employment legal knowledge in support of India senior management, Human Resources and Employee Relations teams on all legal issues related to labour and employment matters. In addition you will also work with others in the legal department to collaborate in providing the same support for Singapore and Malaysia.
- Develop strong advisory and hands-on working relationships with Human Resources and Employee Relations to understand key strategic directions and business initiatives to ensure effective legal support
- Provide legal advisory support to Human Resources and Employee Relations for performance and termination-related matters
- Provide consultation on strategy to mitigate legal risk for matters filed with local labour departments
- Lead multi-dimensional, complex projects of critical importance to Micron
- Advise on decisions the significantly impact the achievement of function or large site objectives
- Provide advice for internal investigations, in-house inquiries, and terminations in accordance with local rules and regulations
- Establish cordial working relationships with local labour department officers to secure latest developments and updates on legislation changes
- Act as a single point of contact to provide Human Resources and Employee Relations of latest local, state, and federal labour legislation changes
- Consult with and manage outside counsel when required to ensure predictability of outcomes under local law and/or practice
- Draft, review, negotiate and revise a variety of documents, often juggling several at times
- Demonstrate and develop practical and innovative ways to meet Micron business needs
- Collaborate with Micron’s global Labour & Employment Legal Team and report to the global head of Labour & Employment
- Potential for global operational and strategic impact
Assist Micron’s Compliance and Ethics team in reviewing and remediating potential compliance issues, including conflicts of interest and third-party due diligence questions.
- Conduct internal investigations as directed by Sr. Management
- Assist in conducting Compliance & Ethics training
- Support Compliance & Ethics’ communication and process implementation efforts
- Provide key stakeholders with timely updates on Compliance & Ethics regulatory developments
- Assist and work with the global Labour & Employment Legal Team as needed to ensure compliance with Micron policies and local laws
- Help identify any appropriate legal training needed to our team members
Significant Experience Handling Contentious And Non-contentious Matters For Employers Across The Spectrum Of Employment, Labour And Industrial Relations Law, Is Desired, Including
- Advising on, drafting and handling disputes about employee contractual documents, policies and handbooks
- Advising on the requirements of and handling disputes arising under common labour and employment laws, including the Industrial Disputes Act, the various state Shops and Establishments Acts, and the various Acts about minimum wages, working conditions and benefits for employees
- Advising on the requirements of and handling matters arising under employment-related social security laws, including ESI, gratuity and provident fund
- Advising on disciplinary, investigatory and employment-termination processes, including with respect to poor performance, misconduct allegations and allegations of sexual harassment
- Interacting with, and responding to and resolving complaints and investigations from, labour and social security authorities
- Advising on requirements and structures associated with non-statutory employee remuneration and benefits, for example employee stock options/restricted stock units
- Advising on, drafting contractual documents for and handling disputes about non-employee workers, including independent contractors and contract labour
- Advising on and handling disputes about breaches of confidentiality and other interferences by workers and ex-workers with an employer’s business (solicitation; trade secret theft etc.)
- Advising on and drafting documents addressing privacy issues for workers
- Advising on, drafting documents for and handling issues and cases related to occupational safety and health requirements and breaches
- To the extent not covered above, direct involvement representing employers in litigation before courts on labour and employment matters
