About: Adv. Ashutosh Nagar is currently based in New Delhi, practicing civil commercial laws with a key focus on arbitrations and intellectual property laws. He started his career as an Advocate at Law Chambers of J. Sai Deepak where he assisted Mr. Sai Deepak for three years on various cases ranging from civil commercial disputes, international commercial arbitrations, and constitutional law matters. Thereafter, he worked with AKS Partners for two years, where he was made a Senior Associate and a team lead. In May of 2021, he founded Ashutosh Nagar & Associates and have since been practicing as an independent Advocate.
He has served as an Advocate in numerous high-value international arbitrations under International Centre for Settlement of Investment Disputes (ICSID) Convention Arbitration Rules, International Chamber of Commerce (ICC) Arbitration Rules, London Court of International Arbitration (LCIA) Arbitration Rules, and Singapore International Arbitration Centre (SIAC) Rules. He also served and advised clients in securing Third-Party Funding from international funders for strategic and effective proceeding of international arbitrations.
He represented and advised clients on numerous intellectual property law cases, which includes telecom SEP litigations between Indian mobile handset manufacturers and SEP holders, litigations between the State of Madhya Pradesh and the Union of India concerning the State’s inclusion in the Geographical Indication (GI) of Basmati Rice and opposition to the GI area demarcated by a statutory body of the Union, and numerous trademark, copyright, and design infringement cases, before the Supreme Court of India, High Court of Delhi, High Court of Madras, High Court of Bombay, IPAB, Registrar of GI, and Registrar of Trademarks.
He assisted the Supreme Court of India in the Special Leave Petition of United Biotech Private Limited v. Orchid Chemicals and Pharmaceuticals Ltd. & Ors. (popularly known as the Patel Field Marshal judgment), wherein the Court decided on the procedure to be followed under Section 124 of the Trade Marks Act, 1999 i.e. procedure for stay of suit proceedings where an issue on the invalidity of a registered trademark is framed.
He also assisted the Constitutional Bench (5 Judge Bench) of the Supreme Court of India in the Writ Petition of Indian Young Lawyers Association v. State of Kerala & Ors. (popularly known as Sabarimala Temple case), where the Supreme Court decided on the issue of whether Sabarimala Temple can be opened for women of all age groups.

The current position is for Advocates registered with the Bar Council of Delhi with up to 2 years of experience of working at Courts in Delhi.
Responsibilities:
The areas of law the prospective Associate will be required to largely practice are Civil Commercial Laws, including Intellectual Property laws, Dispute Resolution laws, and Insolvency and Bankruptcy laws to name a few. Prior work and internship experiences in the relevant areas of law will be considered.
